Terms of Use

These Terms of Use ("Terms") form an agreement between you and Roman Lytin, operating as Wipely ("Wipely", "we", "us" or "our"). They apply to the Wipely iOS application ("App"), the Website at wipely.io, and related services.

By downloading, accessing, purchasing or using Wipely, you agree to these Terms and the Privacy Policy. If you do not agree, do not use Wipely. You must be at least 13 years old and legally permitted to use the service in your country. If you are not old enough to enter into a binding agreement, a parent or legal guardian must accept these Terms for you.

Wipely provides tools that may help you:

• Review and organise photos and videos.
• Identify possible duplicate or unnecessary items.
• Merge or remove contacts.
• Review and remove calendar events.
• Find email subscriptions and recurring messages.
• Unsubscribe from supported senders.
• Move selected emails to trash.
• Estimate potentially recoverable storage.
• Wipely provides suggestions and previews. You remain responsible for reviewing and confirming every cleanup action.
• Storage estimates, duplicate detection, classifications and recommendations are approximate and may not always be complete or accurate.

Subject to these Terms, Wipely grants you a limited, personal, non-exclusive, non-transferable and revocable licence to use the App on Apple devices you own or control, as permitted by Apple’s usage rules. You may not:

• Copy, sell, rent, sublicense or commercially redistribute the App.
• Reverse engineer or attempt to extract source code, except where applicable law expressly permits it.
• Circumvent subscriptions, security controls, permissions or usage restrictions.
• Use Wipely to access another person’s device, accounts or information without authorisation.
• Interfere with the operation or security of the App, Website, Google, Microsoft, Apple or email-sender systems.
• Use Wipely for unlawful, abusive, deceptive or fraudulent activity.

Some features require access to Photos, Contacts, Calendar, Gmail, Google Workspace, Outlook or Microsoft 365. You choose whether to grant these permissions. You represent that you are authorised to access and modify all connected accounts and device data.

You may revoke permissions or disconnect an email account at any time. Some features will stop working after access is revoked. Your use of Google, Microsoft, Apple and other third-party services is also governed by their respective terms and policies.

Wipely performs destructive actions only after user confirmation. However, deletion, merging, unsubscribe and mailbox actions may be permanent or difficult to reverse. Before confirming an action, you should:

• Review the selected items.
• Keep appropriate backups.
• Confirm that your device and cloud services have completed syncing.
• Verify that you are operating on the intended account.
• Wipely is not a backup service.
• The undo option, where available, is provided for convenience and is not guaranteed to restore every item or field.

Wipely may offer auto-renewing subscriptions through Apple’s App Store. Before confirming a purchase, the App Store purchase interface will display:

• The subscription period.
• The current price and currency.
• Included features.
• Any free-trial or promotional eligibility.
• The renewal terms.
• Payment is charged to your Apple Account after confirmation.
• Unless cancelled, an auto-renewing subscription renews automatically for the displayed subscription period. Apple may charge your account within 24 hours before the end of the current period.
• Prices may vary by country, currency, tax and App Store pricing changes.

A free trial or promotional offer may be available only to eligible users. Unless cancelled before the trial ends, the subscription automatically converts to a paid subscription at the price displayed before purchase.

Eligibility, duration, billing and redemption are determined by Apple and the applicable App Store offer configuration. Promotional language inside the App does not override the final terms displayed in Apple’s purchase confirmation sheet.

You can manage or cancel a subscription through your Apple Account’s App Store subscription settings. Deleting the App does not automatically cancel an active subscription. Cancellation takes effect at the end of the current billing period unless Apple states otherwise.

Purchases and refunds are processed by Apple and are subject to Apple’s Media Services Terms and applicable consumer law. Wipely cannot directly issue an App Store refund. Nothing in these Terms limits any mandatory refund, withdrawal or consumer rights available under applicable law.

Wipely interacts with services operated by Apple, Google, Microsoft, email providers, email senders and Website infrastructure providers. We do not control and are not responsible for:

• Third-party availability or outages.
• Changes to provider APIs or permissions.
• Email-sender unsubscribe systems.
• Provider security or privacy practices.
• Cloud-synchronisation delays.
• Actions taken directly in your Apple, Google or Microsoft account.
• Links to third-party websites are provided for convenience and do not constitute endorsement.

Our handling of information is described in the Wipely Privacy Policy at https://wipely.io/privacy. By granting device or account access, you authorise Wipely to process the relevant information as described in that Policy.

Wipely, including its software, interface, branding, graphics, text, animations and other original materials, is owned by or licensed to Roman Lytin and is protected by applicable intellectual-property laws.

Apple, App Store, iCloud, Gmail, Google Workspace, Outlook and Microsoft 365 are trademarks of their respective owners.

We may update, modify, suspend or discontinue parts of Wipely to:

• Improve functionality or security.
• Maintain compatibility with iOS or third-party services.
• Comply with legal or platform requirements.
• Address abuse or technical problems.
• We do not guarantee that every feature will always be available or compatible with every device, operating-system version, account or region.

To the maximum extent permitted by law, Wipely is provided "as is" and "as available." We do not guarantee that:

• Every duplicate or cleanup opportunity will be detected.
• Every recommendation will be correct.
• Storage estimates will exactly match iOS storage reporting.
• Every sender will support automatic unsubscribe.
• Deleted or modified information can always be restored.
• The App or Website will be uninterrupted or error-free.
• Mandatory statutory warranties and consumer rights remain unaffected.

To the maximum extent permitted by applicable law, Wipely and Roman Lytin will not be liable for indirect, incidental, special, consequential or punitive damages, including loss of data, contacts, calendar events, emails, profits or business opportunities.

Where liability cannot be excluded, our total liability will be limited to the greater of the amount you paid for Wipely during the 12 months preceding the claim, or the minimum amount required by applicable law. These limitations do not apply where liability cannot legally be limited, including liability for fraud, intentional misconduct, gross negligence, death, personal injury or mandatory consumer protections.

You may stop using Wipely at any time. We may suspend access to services under our control if you materially violate these Terms, misuse the service, threaten its security or create legal risk.

Termination does not automatically cancel an App Store subscription. Subscription cancellation must be completed through Apple. Sections intended to survive termination, including intellectual property, disclaimers, liability limitations and dispute provisions, will remain effective.

These Terms are between you and Roman Lytin, not Apple. Apple is not responsible for the App, its content, maintenance, support, warranties or claims relating to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the applicable provisions against you.

Your use of the App must comply with the App Store usage rules and Apple Media Services Terms. Apple’s Standard Licensed Application End User License Agreement applies to the extent required and supplements these Terms.

These Terms are governed by the laws of Germany, excluding conflict-of-law rules. If you are a consumer, this choice does not remove mandatory protections or rights available under the laws of your place of residence. Any dispute will be submitted to the competent courts determined by applicable law.

We may update these Terms to reflect changes to Wipely, legal requirements, subscriptions or third-party services. The updated Terms will be posted at wipely.io/terms with a revised effective date. Material changes may also be communicated inside the App. Continued use after the effective date constitutes acceptance where permitted by law.
